What a sheriff sale is

A sheriff sale is the public auction at the end of a New Jersey foreclosure. In Hudson County, the Hudson County Sheriff’s Office runs it.

The official listings are published by the Sheriff’s Office. A public sales list is also posted as a public service of the Sheriff’s Office. This page is not that calendar. Jose reads the public list and sends the upcoming sales, with his notes.

The office says foreclosure sales are held on Thursdays, twice a month, in Jersey City. Confirm the date, time, and room on the official page before you rely on them. The office says its rules can change at any time.

Town property-tax sales are a different auction. The Sheriff’s Office says it handles county foreclosure sales of real property, and that each town’s tax office auctions property-tax sales.

For buyers and investors

Properties at a Hudson County sheriff sale are usually sold as-is. The Sheriff’s published conditions say each property is sold subject to restrictions of record, unpaid taxes and water or sewer charges, and whatever a survey and a physical inspection would show. Buyers typically do not get an interior walkthrough before the auction. Plan on that.

If you are the high bidder, the Sheriff’s Office currently says you must pay a deposit of at least 20% of the bid, immediately, by certified or cashier’s check. Cash, cards, and personal checks are not accepted. Those same published conditions say the balance is due between the 11th and the 30th day after the sale. Those figures are the Sheriff’s, and the office says they can change. Read the current conditions on the official page before you bid.

Do a title search. Check liens, taxes, and association charges that may survive the sale. Buying at the auction is not a typical closing, with an inspection and a mortgage contingency.

Buying at the auction is different from buying a bank-owned (REO) property afterward. At the auction you bid under the Sheriff’s rules. If the lender wins, the home may come back to market as a bank-owned listing, where a buyer can often inspect and finance. Jose can help with both.

For homeowners and heirs facing a sale

If your home — or a home in the family — has a sheriff sale date, there may still be options before that date. Talk with a New Jersey attorney. Ask the loan servicer whether reinstatement is still open. A sale on the open market, before the auction, is sometimes the calmer path when there is time and a buyer.
